Information according to Article 13 GDPR

 

When you visit or use our website, we take the protection of your personal data very seriously. We only process your data on the basis of legal provisions (in particular the General Data Protection Regulation, the Austrian Data Protection Act and the Telecommunications Act) and would like to inform you about important aspects of our data processing below. We, the Wiesen Apartments based in Axams, as the operator of this website.

 

Our website

So that we can make our website user-friendly, we use cookies and external integration (e.g. Google Maps), which may come from third-party providers. For a detailed list of the cookies and integrations we use, please see the sections “Our cookies” and “Our external integrations” below.

If cookies and external links come from US service providers (e.g. Google), information about you (e.g. IP address, usage behavior, technical data) may be transmitted to the USA as a third country. Since there is no adequate level of data protection in the USA, we will obtain your express consent for this.

Please note that in the case of transfers to third countries without an adequacy decision by the European Commission or the existence of suitable guarantees, there is no adequate level of data protection and there may therefore be risks for you. Among other things, US authorities can access your data without there being any effective legal protection.

Apart from data transmissions, which take place in the course of the use of cookies and/or similar technologies, the personal data collected from you is transmitted in particular if we use external service providers for hosting the website (e.g._cc781905-5cde-3194-bb3b -136bad5cf58d_www.wix.com) consult. We have concluded an order processing contract with such external service providers in accordance with Article 28 of the General Data Protection Regulation. In this contract, we oblige external service providers to keep your personal data secret and to take appropriate data security measures.

If there are external service providers in third countries, they have either been classified as safe third countries by an adequacy decision by the European Commission or we have taken suitable guarantees (e.g. standard contractual clauses) as alternative protective measures. Our cookies

"Cookies" are small text files that are stored on your end device with the help of the browser. Our external integrations

External integrations are small programs with which we offer additional functions for our website. This particularly concerns our integration of Google Maps. When using external integration, certain information (e.g. IP address) can be collected from you and transmitted to third parties. If we do not state another legal basis, we generally base the data processing on your consent. You can revoke your consent to the use of our plugins at any time by leaving our website.

 

We use the following external integrations:

Google Maps: In order to make our location easier to find, we have included the “Google Maps” map service from Google Ireland Limited (Google), Gordon House, Barrow Street, Dublin 4, Ireland, on our website. In the course of using Maps functions, user data is transmitted to Google servers in the USA. You can find more information about Google Maps here.

 

your contact

If you contact us via our reservation function, our contact form or our other contact details (e.g. address, e-mail address, telephone number), we will use the personal data you have provided exclusively for the purpose of processing and answering your request. In doing so, we rely on our legitimate interests (Article 6 Paragraph 1 litera f General Data Protection Regulation). If you already send us specific inquiries about our services when you contact us or if you want advice from us in this regard, we also rely on the fulfillment of pre-contractual obligations (Article 6 Paragraph 1 lita b General Data Protection Regulation). Without processing your personal data, we would not be able to answer your request.

The personal data you provide will not be passed on to third parties or disclosed to them. Exceptions to this only exist if we are obliged to transmit or disclose data due to legal provisions or if you have given us your prior consent to do so.

In the event of misuse of our website, we reserve the right to forward disclosed personal data to the responsible authorities.

 

Our Facebook page

If you visit our Facebook page, personal data (usage behavior) will be processed by Facebook using cookies. This information is used to create anonymous, statistical data on site activity and make it available to us automatically (so-called insights). In accordance with Article 26 of the General Data Protection Regulation, we are jointly responsible with Facebook for this data processing. In doing so, we rely on our legitimate interests. Without the processing of this data, the presence and optimization of our offer on Facebook would not be possible.

We have concluded an agreement on joint responsibility with Facebook in accordance with Article 26 of the General Data Protection Regulation (Addition for responsible persons). For more information see den Facebook Privacy Policy.

 

Our data storage

Personal data you provide will only be stored by us for as long as is necessary for the purposes mentioned above - for which we process the data.

Due to legal documentation and storage requirements, the storage period may be longer. After the relevant periods have expired, your personal data will be deleted, provided that there is no other legal basis for longer-term storage under the General Data Protection Regulation.

 

Your rights

You have the right to information

  • whether we process your personal data,

  • for which purposes your personal data is processed,

  • which categories of your personal data are processed,

  • to which recipients your personal data is transmitted, and

  • how long we store your personal data (Article 15 of the General Data Protection Regulation).

You have the right to rectification if your personal data is being processed incorrectly. This also includes completion if your personal data is not processed in full (Article 16 of the General Data Protection Regulation).

You have the right to erasure (“right to be forgotten”) if there is no longer a suitable legal basis for the processing of your personal data under the General Data Protection Regulation (Article 17 General Data Protection Regulation).

Under certain conditions, you have the right to request that the processing of your personal data be restricted (Article 18 of the General Data Protection Regulation).

You have the right to receive personal data that you have provided to us in a structured, common and machine-readable format and to transmit it to a third party of your choice (data portability), provided that the detailed requirements for this are met (Article 20 of the General Data Protection Regulation ).

If we base the processing of your personal data on our legitimate interests, you have the right to object on grounds relating to your particular situation (Article 21 General Data Protection Regulation).

If you have consented to the processing of your personal data, you have the right to withdraw your consent at any time (Article 7 (3) of the General Data Protection Regulation).

If you believe that the processing of your personal data violates the General Data Protection Regulation or any other regulation relevant to data protection, you are free to lodge a complaint with the Austrian data protection authority (https://www.dsb.gv.at/) to lodge a complaint.

REPORTING DATA

1.1 Duty to Report

According to the Austrian Registration Act, you are obliged to register with us using the data specified in Sections 5 and 10 of the Registration Act. This applies to the following data: name, date of birth, gender, nationality, country of origin, address including postal code and - for foreign guests - type, number, date of issue and issuing authority of a travel document as well as the date of arrival and departure.

 

1.2 Guest Directory

Due to the legal obligation imposed on us in accordance with Section 19 of the Registration Act Implementation Ordinance, we will keep this data in a guest directory and store it for a period of 7 (seven) years, unless it is used for other purposes specified in this

data protection declaration are processed longer 

 

1.3 Sharing of Data. The data categories "Arrival", "Departure" linked to the country of origin are forwarded to the municipality in which our accommodation is located in accordance with §6 Tourism Statistics Ordinance. Aggregated data on the total number of overnight stays and the persons who are obliged to pay the residence tax must also be sent to Innsbruck Tourismus, to which we belong, and/or the municipality. This is done on the basis of Section 19 of the Tyrolean Residence Tax Act.

1.4 Legal Basis for Processing

The processing in accordance with points 1.1 bis above is based on Article 6 (1) (c) GDPR.

1.5. Additional data transmission to TVB/municipality

In addition, we forward your postal code and your year of birth (in pseudonymised or anonymous form) to our municipality and our TVB for the creation and evaluation of origin and age statistics by the tourism association. This redirect

is based on Art. 6 Para. 1 lit e (task in the public interest) and lit f (overriding legitimate interests) GDPR. You can object to this at any time for reasons that arise from your particular situation (Article 21 (1) GDPR).

GUEST CARD

2.1 General

You have the option of using a guest card. The guest card grants you a discount on the tariffs for scheduled services. The guest card is valid for the period of your stay with us.

2.2 Issuing the guest card

The guest card is only issued by the accommodation provider at your request. It is issued according to the guest card system used by the accommodation facility, either in the form of a carbon copy of the registration form.

2.3 Processed personal data If the guest card is issued in the form of a "registration form", this contains the content according to Section 5 in conjunction with Section 9 of the Registration Act (see point "Registration data" 1.1 above). In this case, there is no electronic processing for the purposes of the guest card. There is no processing of the guest card data by the tourism association or by

the line operator.

2.4 Legal Basis for Processing

The processing of the data for the purposes of the guest card is based on your consent (Article 6 (1) (a) GDPR). You can revoke your consent verbally to the accommodation provider at any time.

2.5 Recipients of the data

To claim the discount, you must show the bus driver the respective guest card on which the data is shown and thus disclose it yourself. This checks visually whether it is (still) valid.
